CANCELLATION AND REFUND CONDITIONS
I. PAYMENTS A) Standard Tours: At least 35% of the reservation fee must be paid at the time of registration. The remaining balance must be paid at most 3 days before the trip starts. If payments are not made within these periods, the reservation will be canceled, and 35% of the fee will be billed to the consumer as a withdrawal penalty. B) Discounted Services: Consumers purchasing discounted/promotional services are required to pay the full service fee (100%) on the reservation date. C) Special Products: For special products and services, the balance must be paid at most 60 days before the service starts. The withdrawal penalty is the same as in Article I/A. D) Daily Tours: The full tour fee is collected at the time of registration; there is no pre-reservation option.
II. CANCELLATION & TRANSFER
Agency Cancellation Rights: BMT Travel may cancel or postpone the trip due to insufficient participants despite showing due diligence, or due to adverse weather conditions, road obstacles, strikes, terrorism, fog, war, possibility of war, unforeseeable technical issues, and all force majeure reasons. In this case, the consumer has no right to compensation.
Consumer Cancellation Terms:
A/B) Standard Tours & General Cancellation Policy: The following cancellation fees apply based on the time of cancellation prior to the service start date:
31 Days or more before: Full refund is made (0% penalty).
30 to 28 Days before: The consumer agrees to pay 25.0% of the total service fee.
27 to 21 Days before: The consumer agrees to pay 50.0% of the total service fee.
20 to 13 Days before: The consumer agrees to pay 75.0% of the total service fee.
12 Days or less before: The consumer agrees to pay 100.0% of the total service fee.
Note: Date changes made by the consumer are considered as cancellations and are subject to the penalties above.
C) Discounted Services: For discounted/promotional services, the same conditions as Article II/A/B apply unless otherwise specified in the promotion terms; however, promotional tickets are generally non-refundable.
D) Cruise & Flight Packages:
Cruises: The cruise company's cancellation conditions apply. Typically: Up to 77 days (100 Euro fee); 76-60 days (25%); 59-45 days (40%); 44-31 days (60%); 30-21 days (80%); 20-0 days (100% penalty).
Flights: For packages with flights, the airline's cancellation conditions apply based on the ticket status.
E) Medical Exceptions: Documented severe illness or death of the consumer or their 1st-degree relatives, preventing their routine activities for 10 days (proven via an official board report from a full-fledged state hospital submitted before the service starts), is an exception to these cancellation penalties.
Transfer Rights: The consumer can transfer the tour to another person up to 7 days before the start, provided the agency is notified in writing. The transferee is jointly responsible with the transferor for the balance and all costs arising from the transfer.
No-Show: If the consumer misses the start of the service and does not notify in writing that they will join later, the agency has the right to cancel all reservations and services after 24 hours. No refunds will be made in such cases.
Itinerary Changes: The agency may cancel the tour partially or completely before the start if deemed necessary. Within the same period, it may change hotel names, transportation vehicles, departure points, and the order of visits in the program.
Flight Rules: Airline conditions apply to cancellations/changes. Promotional tickets are non-refundable and non-changeable. If a hotel reservation with a promo ticket is canceled, the full cost of the flight ticket is deducted from the refund.
Airport Check-in: Guests must be at the airport at least 1.5 hours before domestic flights and 2 hours before international flights. ID is required for domestic, Passport for international flights. Driver's licenses are not accepted for flights.
Accommodation & Daily Tours (Late Cancellation): Since the general cancellation policy (Article II/A/B) imposes a 100% penalty for cancellations made 12 days or less before the tour, this rate also applies to late cancellations for accommodation and daily tours.
III. GENERAL PROVISIONS
Baggage: Responsibility for baggage and its contents belongs to the owner. The consumer must comply with the laws and customs applicable to the vehicle and facility used.
Lost/Damaged Baggage: In cases of baggage loss/damage caused by the provider's gross negligence; if the consumer has a Loss/Damage Report issued, the agency will pay 1/2 of the transportation portion of the total tour fee as compensation, regardless of the value of the items. The agency is responsible for lost/stolen items declared in writing with their value, up to the transportation cost of the trip.
Visas: Visa procedures and services are not included in the purchased service. The agency may assist for a fee but is not responsible for rejections as the counterparts are the passenger and the consulate.
Force Majeure & Liability: The agency is responsible for reasons other than force majeure, consumer fault, or 3rd party personal responsibilities. In cases within its responsibility, the agency may compensate per the TÜRSAB Kütahya Schedule or provide alternative services during the trip. Accepting alternative services voids the right to a refund.
Consumer Conduct: The consumer agrees to comply with the rules of the guide, facility, and vehicle; to respect the life and property of others; otherwise, they may be denied service without a refund.
Defective Service: If the consumer leaves the tour claiming defective service, they must notify the Agency Official and the hotel in writing with reasons. Otherwise, they are deemed to have received and used the service.
Complaints: Good faith consumers must notify the Agency in writing of any complaints during the performance of the service.
Proxy Signature: Consumers who do not sign the contract but participate in the service are deemed to have accepted the terms when the designated person signs on their behalf.
Insurance: Per Law No. 1618, failure to provide the package tour is covered by insurance up to the package tour price. This is not health insurance.
Minors Traveling Abroad: For international tours, children under 18 traveling without one or both parents must carry a notarized Letter of Consent from the absent parent(s).
Right of Withdrawal: The consumer has the right to withdraw by applying in writing within (7) days of the contract becoming valid. The service fee is refunded within 10 days of receiving the documents. If the original invoice is not returned, VAT and legal obligations are not refunded.
Compensation Calculation: The provisions of the TÜRSAB KÜTAHYA SCHEDULE apply for calculating compensation in case of agency non-compliance.
Acknowledgment: The consumer declares they have read and confirmed all preliminary information regarding the service qualifications, sales price, and payment method electronically.

8. Cruise Supplement: A supplementary cruise contract will be signed for cruise tours. 9. DISPUTES AND AUTHORIZED COURT: The parties accept that Turkish Law will apply and Bolu Courts and Enforcement Offices are authorized for any disputes arising from this Agreement.
